Welcome to BrokerBuddie.ai ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the BrokerBuddie.ai website, platform, tools, applications, and services (collectively, the "Service"). By registering, accessing, or using any part of BrokerBuddie.ai, you agree to these Terms.

If you do not agree, you must not access or use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements. You may only use the Service for lawful purposes and in compliance with all applicable laws and regulations.

2. Account Registration & Security

You must provide accurate, current, and complete information when creating an account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

We reserve the right to suspend or terminate accounts that provide false, misleading, or incomplete information.

You must notify us immediately of any unauthorized use or suspected breach of security. We are not responsible for any loss resulting from your failure to protect account credentials.

3. Subscription Plans, Pricing & Modifications

BrokerBuddie.ai offers both free and paid subscription plans with varying access levels, billing cycles, and usage limits.

We reserve the full and sole right to, at any time and without prior notice:

  • Change, modify, increase, or remove any plan, feature, or billing structure

  • Adjust subscription pricing or billing amounts at our discretion

  • Introduce new fees, credits, or usage limits as part of service updates

  • Cancel, restrict, or terminate memberships or plans for any reason

All price or plan changes take effect immediately upon posting or at the start of the next billing cycle, at our discretion. Updated pricing will apply automatically unless you cancel your subscription before your next billing date.

We may also migrate existing users to updated plan structures to maintain consistency across the platform.

Refunds are not issued for unused time or plan changes unless required by law.

Continued use of the Service after any change constitutes your acceptance of the updated pricing and terms.

4. Fair Use & Acceptable Conduct

You agree to use the Service responsibly and not engage in activity that harms or disrupts the platform, including:

  • Excessive or abusive use of AI tools or automation features

  • Attempting to bypass limits, reverse-engineer code, or exploit vulnerabilities

  • Uploading malicious software, spam, or illegal content

  • Using the Service to produce or distribute unlawful, deceptive, or unethical material

We may throttle, suspend, or terminate access to accounts that violate fair use at our sole discretion.

5. Cancellation, Suspension & Termination

We may suspend, restrict, or terminate your account or access to the Service, with or without notice, if:

  • You breach these Terms

  • You engage in misuse, fraud, or illegal activity

  • We determine your activity poses a risk to other users or the platform

We may also discontinue any portion of the Service or any plan at any time without liability.

You may cancel your account at any time through your dashboard or by contacting support. Upon cancellation, access to your account will end immediately, and your data may be deleted after a retention period. No refunds will be issued except as required by law.

6. Intellectual Property Rights

All content, software, trademarks, designs, and materials provided by BrokerBuddie.ai are our property or that of our licensors and protected by applicable intellectual property laws.

You may not:

  • Copy, distribute, or reproduce any part of the Service

  • Reverse-engineer, decompile, or create derivative works

  • Use the platform to build or enhance a competing product or service

User-generated content (e.g., files, prompts, feedback) remains your property. However, you grant us a non-exclusive, royalty-free license to process and use your content solely to deliver the Service.

7. AI Tools & Generated Content

BrokerBuddie.ai uses AI technologies from third-party providers such as OpenAI, Google, and Anthropic to generate insights, automate workflows, and support content creation.

You acknowledge that:

  • AI outputs may contain inaccuracies or biases

  • Generated content is not professional, legal, or financial advice

  • You are solely responsible for how you use AI-generated information

We do not store or use your data for AI training and have opted out of such programs where applicable.

8. Third-Party Services & Integrations

We may integrate with third-party tools (e.g., Google, Zoho, LinkedIn, Facebook, CRMs, payment processors). We are not responsible for:

  • Third-party performance, security, or data handling

  • Errors or downtime caused by integrations

  • Third-party privacy or compliance obligations

You must comply with the terms of each third-party provider independently.

9. Data Privacy

Your data is managed in line with our Privacy Policy, which explains how we collect, use, and protect your information.

By using the Service, you consent to the data practices described in that policy.

10. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including but not limited to:

We do not guarantee uninterrupted or error-free operation, or that the Service will be free of harmful components.

  • Indirect, incidental, special, or consequential damages

  • Lost profits, data, or business opportunities

  • AI-generated inaccuracies

  • Unauthorized access or use of your data

Our total liability for any claim shall not exceed the amount you paid for the Service during the 3 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless BrokerBuddie.ai, its directors, officers, employees, and affiliates from any claims, damages, or expenses arising from:

  • Your use or misuse of the Service

  • Violation of these Terms

  • Infringement of third-party rights

  • Misuse of AI-generated content

13. Modifications to the Service or Terms

We may modify, suspend, or discontinue any aspect of the Service or its pricing structure at any time, without notice or liability. We may also update these Terms at our discretion.

The latest version will always be available on our website. Continued use of the Service after any updates means you accept the revised Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Melbourne, Victoria.

15. Entire Agreement & Severability

These Terms, along with our Privacy Policy and any other legal notices or agreements referenced herein, constitute the entire agreement between you and BrokerBuddie.ai.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision under these Terms does not constitute a waiver of such right or provision.
